Privacy Notice - Effective December 9, 2022

Protecting your privacy is very important to AVTECH. This Privacy Notice describes AVTECH’s policies and practices regarding its collection and use of your personal data, and sets forth your privacy rights. We believe that information privacy and protection is an ongoing responsibility, so will update this Privacy Notice from time to time as practices or policies may change.

AVTECH Software, Inc. is a USA corporation registered in the state of Delaware and headquartered in Warren, Rhode Island. Its wholly-owned subsidiary, AVTECH Software, Ltd. is an Ireland corporation in the EU. AVTECH’s business does not currently require the mandatory assignment of a Data Protection Officer. Data Protection and Privacy responsibility within AVTECH will be managed by our privacy team, none of which are individually considered a DPO. How We Collect & Use (Process) Your Personal Information

  1. Personal Information You Give To Us
    1. Website Inquiries

      You may choose to request information from AVTECH using various forms or fields found on our websites. These include Live Chat links, Support Tickets, Quote Requests, Vendor Setup Requests, Reseller Requests and others. Certain fields may be required so that AVTECH can effectively respond to your request. When you provide your personal data through these website forms and links, we may retain that information and use it to respond to your inquiry, notify you about related products or services you may be interested in, keep a record of your request, and keep a record of the response to your request.

      AVTECH may determine that an authorized reseller may be in your region who is best suited to respond to your request, and may share your personal data with the authorized reseller as a third party. All AVTECH authorized resellers have agreed to acceptable privacy policies. AVTECH requires all authorized resellers to return a signed reseller agreement stating these and other requirements prior to receiving any personal data from AVTECH.

    2. Correspondence

      When you correspond with us by email, fax, mail or other form of communication, we may retain that correspondence and the information contained in it and use it to respond to your inquiry, notify you about related products or services you may be interested in, keep a record of your request, and keep a record of the response to your request. If you wish to have AVTECH erase your personal information or otherwise refrain from communicating with you, please contact our privacy office at Privacy@AVTECH.com.

      If you ask AVTECH not to contact you by email at a specific email address, AVTECH will retain a copy of the email address and request in order to comply with your no contact request.

    3. Software & Services

      When you use our software and services, you may at times enter personal information including your name, email address, organization name and more. We use this information to ensure your contact information is up to date and to provide continued access to your account resources using the contact information you entered. This information is not shared with third parties at any time other than to store the information in hosted databases.

    4. Payment Information

      You may choose to purchase products or services from AVTECH using a credit card. Typically, credit card information is provided directly by users through one of our secure websites, and into the PCI/DSS compliant processing service that AVTECH subscribes to. Occasionally, customers may ask AVTECH employees to, on their behalf, enter credit card information into the payment system. We strongly encourage customers to enter the information through our secure website and not by email, fax, phone or mail. When we receive payment information from customers by email, fax, phone or mail, it is entered to process the payment, then deleted or destroyed.

    5. Purposes For Processing Your Data

      AVTECH processes your data to provide you with the products and services you have requested or purchased from us. We use this information to improve our products and services, and to communicate with you about other products and services AVTECH offers that may benefit you or your organization.

  1. Personal Information From Third Parties

    AVTECH may receive personal information from third parties. This may happen if your employer is a customer of AVTECH’s and registers you for access to our products or services. A third party may provide your personal information if you attend a trade show or industry event that AVTECH is associated with. You may also work with an AVTECH Reseller who provides your personal information to us for a quote, purchase, sales or support request.

  2. What Happens If You Don’t Provide Your Personal Information

    AVTECH has many resources available through its websites that do not require that you provide us with your personal data. Personal information is required so that AVTECH can provide you with the products and services you have purchased or requested, and to authenticate you or your organization to ensure we are providing services to authorized users. You may opt-out of receiving marketing communication at any time.

Use Of AVTECH Websites

As is common for most other websites, AVTECH’s websites collect certain information automatically and store it in log files. The information main contain IP addresses, the general location where you are accessing the internet from, your web browser type and version, your operating system type and version, and other information related to the use of AVTECH’s websites including a history of the pages you view and resources you download. We use this information to help us design sites that display properly and perform well for all users, web browsers and operating systems. AVTECH’s websites use cookies and web beacons. “Do Not Track” is still and developing standard, and therefore do not currently respond to Do Not Track (DNT) signals.

  • Cookies & Web Beacons

    Cookies are small pieces of data that a website transfers to your device storage for record-keeping purposes. Web beacons are transparent pixel images that are used to collect information about website usage, email response and tracking.

    AVTECH uses cookies and web beacons to provide enhanced functionality (e.g., login prompts, session status, shopping cart contents) and to aggregate traffic data (e.g., what pages or resources are most popular). These cookies may be delivered in a first party or third party context. AVTECH may also use cookies and web beacons with emails sent by AVTECH. There are many choices available to manage cookies on your computer or device. All major browsers allow you to block or delete cookies from your device. To learn more, please refer to the privacy features in your browser.

    AVTECH uses Google Analytics, a web analytics service provided by Google, Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purposes of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google.

    You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of AVTECH websites. By using AVTECH websites, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

  • Do Not Track (DNT)

    AVTECH tracks users when the cross from one AVTECH website to another (e.g., from AVTECH.com to RoomAlert.com), as well as when visitors come to our website from a marketing email or landing page. California and Delaware law currently require us to indicate whether we honor “Do Not Track” settings in your browser concerning targeted advertising. “Do Not Track” is a developing standard that has not yet been finalized, so AVTECH adheres to the standards set out in this Privacy Notice and does not monitor or respond to Do Not Track browser requests.

    AVTECH uses several Google products including Analytics, AdWords and AdSense. Google, as a third-party vendor, uses cookies to serve ads on our site. Google’s use of the DART cookie enables it to serve ads to our users based on previous visits to our site and other sites on the Internet. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy notice. Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative Opt Out page or by using the Google Analytics Opt Out Browser add on. Google’s advertising requirements can be summed up by Google’s Advertising Principles.

  • Linked Websites

    For your convenience and to enhance the content available on our websites, hyperlinks may be posted that link to other websites (the “Linked Sites”). AVTECH is not responsible for, and this Privacy Notice does not apply to, the privacy practices of any Linked Sites or of any companies that we do not own or control. We encourage you to seek out and read the privacy notice or notice of each Linked Site that you visit to understand how the information that is collected about you is used and protected.

When & How We Share Information With Others

Information about your organization’s purchases, quotes, support requests and other interactions with AVTECH are maintained in association with your organization information and personal information. The information AVTECH collects from you is stored in one or more databases at AVTECH owned facilities, or hosted by third parties located in the United States. Third parties do not use or have access to your personal information for any purpose other than storage and retrieval via database system.

We do not reveal your personal data to third parties for their independent use unless: (1) you request or authorize it; (2) the information is provided to comply with the law, enforce an agreement we have with you, or to protect the rights, property and safety of our organization, employees or others; (3) the information is provided to authorized resellers who have agreed to acceptable privacy policies and can provide local sales and support service in your country or region; or (4) to address disputes, claims or to persons demonstrating legal authority to act on your behalf. We may also gather aggregated data about our customers and site visitors and disclose the results of such aggregated (but not personally identifiable) information to our partners, and/or other third parties for marketing or planning purposes.

Authorized AVTECH Resellers have all agreed to a Reseller Agreement that outlines our expectations for their organization in terms of privacy and information security.

AVTECH websites may interface with social media sites like Twitter, LinkedIn and others. If you choose to like or share information from AVTECH websites through social media services, you should review the individual privacy notice for that service. If you are a member of a social media site, the interface may allow the social media site to connect your site visit to your personal data.

International Data Transfers

AVTECH’s headquarters is in the United States. Information we collect from you will be processed in the United States. AVTECH collects and transfers to the U.S. personal data only, with your consent, to perform a contract with you or to fulfill a compelling legitimate interest of AVTECH in a way that does not outweigh your rights and freedoms. AVTECH aims to provide suitable safeguards to protect the privacy and security of your personal data in a way consistent to what is described in this Privacy Notice. AVTECH minimizes the risk to your rights and freedoms by not collecting or storing sensitive personal information about you.

Data Subject Rights

The European Union’s General Data Protection Regulation (GDPR) and other countries’ privacy laws provide certain rights for data subjects. This Privacy Notice is intended to provide you with the information about what personal data AVTECH collects about you and how it is used or processed. If you wish to confirm that AVTECH is processing your personal data, or to request access to the personal data AVTECH may have about you, please contact our privacy office at Privacy@AVTECH.com.

You may also request information about the purpose of the processing, the categories of personal data, third parties that may have received data from AVTECH, what the source of the information was if provided from a third party, and how long the information will be stored. You have a right to correct the personal data maintained by AVTECH if it is inaccurate. You may request that AVTECH cease using or processing your data, subject to certain exceptions. You may also request that AVTECH cease using your data for direct marketing purposes. In some countries, you have a right to report concerns directly to the appropriate data protection authority in your jurisdiction. When technically feasible and at your request, AVTECH will provide your personal data to you.

Reasonable access to your personal data will be provided to AVTECH customers upon request made to our privacy office at Privacy@AVTECH.com. We may require additional information to validate your identify or confirm that your request is valid. If access cannot be provided within a reasonable time frame, AVTECH will provide you with a date when the information will be provided. If access is denied, AVTECH will provide an explanation as to why access has been denied.

Security Of Your Information

AVTECH is fully committed to data security. To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put in place physical, electronic, and managerial procedures to safeguard and secure the information you provide to us online. We restrict access to your personal data to those employees who need to know that information to provide services to you. We train our employees about the importance of and responsibility to protect the confidentiality and privacy of your personal information.

Data Storage & Retention

Your personal data is stored by AVTECH on its servers at its headquarters, and on the servers of hosted services AVTECH engages, both located in the United States. AVTECH retains data for the duration of your organization’s business relationship with AVTECH, including after services have ended for historical record keeping. Privacy Notice Changes & Updates

By using this site, you agree to the terms and conditions contained in this Privacy Notice and/or any other agreement we may have with you. If you do not agree to any of these terms and conditions, you should not use this site or any AVTECH products or services. You agree that any dispute over privacy or the terms contained in this Privacy Notice, or any other agreement we have with you, will be governed by the laws of the State of Rhode Island, and to abide by any limitation on damages contained in any agreement we may have with you.

As our organization, our products and the privacy industry change from time to time, this Privacy Notice may change as well. We reserve the right to amend or update the Privacy Notice at any time, for any reason, without notice to you, other than the posting of the amended Privacy Notice to this site. The provisions contained herein supersede all previous notices or statements regarding our privacy practices and the terms and conditions that govern the use of this and other AVTECH websites, products and services.
