Washington’s Workplace Rules for Heat Exposure

For employers in Washington, the Washington State Department of Labor and Industries (L&I) has established comprehensive regulations to protect workers from the hazards associated with outdoor heat exposure. These rules are designed to prevent heat-related illnesses and fatalities, and reduce traumatic injuries associated with heat exposure by outlining requirements for businesses to safeguard their workforce.

In June 2023, the Washington State Department of Labor and Industries updated its Outdoor Heat Exposure rules, which apply to all Washington employers with employees who perform work outdoors. Under the new adopted rules, requirements are year-round, in effect whenever workers are exposed to outdoor heat. Specifically, outdoor temperature action levels are 52°F for workers in non-breathable clothing and 80°F in all other clothing. A key component to following Washington’s Outdoor Heat Exposure rules is rest breaks and shade in response to temperature increases. For example, at or above 90°F, a 10-minute cool-down rest period every two hours and close observation to help identify employees showing signs and symptoms of heat-related illness is mandatory.
